Terms and Conditions

Outlined below are the Terms and Conditions which you, the parent or legal guardian of a participating child, are accepting when you book sessions with us, Smudge Art Club.

Registration

When booking online with Smudge Art Club you must create a customer account on our website and it is your responsibility to keep these registration details up to date.  If for any reason you cannot register online, please contact us to make alternative arrangements.

Smudge Art Club will always take steps to facilitate a child’s participation, however some sessions may not be suitable for all children.  We have a duty of care, so if your child has additional needs which may impact the safety of your child or others, please discuss these with us before booking.

When booking, full and accurate information about your child’s medical, physical, behavioural, language, or any other additional needs, must be provided so that we can ensure equipment, activities and services are safe, appropriate and considerate.  Failure to do so may result in a booking being cancelled.

Booking and payment

Bookings may open on various dates in line with individual venues and will be advertised as early as possible on our website.  Places will be offered first to children on waiting lists, then on a first come basis.  For the Monday after school club session, bookings will open first for Hemdean House students, then remaining places will be made available to the public.

Booking and payment is through our website and you will receive an automated reply confirming your place.  In order to pay for sessions online, you must possess a valid credit or debit card issued by a bank acceptable to us with sufficient funds to cover the cost.

Bookings and payments may be made by other means, but we retain the right to refuse any request – please contact us to make alternative arrangements.  All of our sessions must be paid for in advance.  Where spaces are available, you may book onto a course after it has already started and will pay only for the remaining sessions.

Bookings are only secure once payment has been accepted.

Cancellations By You

You have the right to change your mind and receive a full refund on any booking with Smudge Art Club.  You have until 48 hours before the start time of a session to contact us to request a cancellation and refund.

If you cancel a booking made within 48 hours of its commencement, or if you need to leave once a course has already started, a refund is not guaranteed.  Please notify us as soon as possible and we will endeavour to fill your child’s place.  A refund for the session or remaining sessions of a course will only be given if their place can be filled.

Cancellation By Us

Very rarely it may be necessary, due to unforeseen circumstances, to cancel or postpone a session.  In this event we will provide an alternative, be that a make-up session on another date, credit towards future sessions, or a refund.

If a class is cancelled or terminated due to an event beyond the reasonable control of Smudge Art Club, including but not limited to, industrial disputes, school closures, natural disaster, notifiable disease, or extreme adverse weather, we regret that no credit or refund will be offered.  Smudge Art Club will seek to provide a make-up session on another date, but will not be held accountable if this is not possible due to time, location or logistical constraints.

If your child acts in a manner which we believe negatively disrupts the running of a session or impacts the safety of the others, you will be contacted and consulted about a plan of action.  Continued disruptive or unsafe behaviour after this consultation will result in cancellation of your booking, and a refund will only be given if your child’s place can be filled.

Sessions

Our classes are kept small in order to provide high quality instruction, usually with a child teacher ratio around 10:1 for KS2 and 8:1 for KS1, with numbers flexible to accommodate significant circumstances and requests, but will never exceed 15:1.

Please arrive promptly for sessions, as late arrival may cause your child to miss important demonstrations and explanations.

All children must be collected by an adult.  Please collect your child on time.  If you are running late, contact us so that we can make arrangements your child.  In schools, we will usually take your child to their after school club.  Otherwise, we will remain onsite with your child, with a late collection fee of £5.00 for each 10 minutes.

If you miss a session due to illness, holiday, or logistics, we regret that we will not be able to provide a refund.

Safety

Smudge Art Club takes all reasonable steps to make our sessions safe for children and we have public liability insurance in place.  All participants take part in sessions at their own risk.

In our Mini Artists and Community-Based Home Education sessions, parents/carers must supervise their children at all times.  Activities may not be suitable for all children due to small parts or sharp edges.  Age recommendations for activities are displayed, but parents/carers take ultimate responsibility for their children’s supervision and participation.

Privacy

Smudge Art Club collects and processes only the personal information necessary to provide our services and all data handling is in accordance with GDPR regulations.  We never pass your personal information onto third parties and identifying photos are only used with consent.
